Essential Notice: The CliniQ AI provides software tools to assist licensed healthcare providers with clinic operations, queue management, electronic prescriptions, and patient communication. The CliniQ AI is not a healthcare provider and does not practice medicine. All medical decisions, treatment recommendations, and prescription authorizations remain solely with the licensed doctor.
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "Doctor", "Clinic", or "User") and The CliniQ AI Technologies ("The CliniQ AI", "we", "us", or "our"), governing access to and use of our web portal, software services, WhatsApp automated messaging, and voice reception interfaces.
By registering a clinic account, activating the 60-day free trial, or accessing our platform, you agree to comply with and be bound by these Terms.
2. Subscription Plans, 60-Day Trial & Billing Terms
- Base Clinic Operating Plan: The standard subscription is priced at ₹999 per month per clinic (plus applicable GST). This includes unlimited doctor and staff logins, appointment booking, queue token system, electronic prescriptions, and WhatsApp notifications.
- Annual Discount: Clinics opting for annual upfront billing receive a 10% discount (effective ₹899 per month, billed as ₹10,788 annually).
- 60-Day Risk-Free Trial: New clinics are eligible for a 60-calendar-day trial of our base system with zero upfront commitment and no credit card required. You may cancel at any time during or after the trial without penalty.
- AI Voice Receptionist (Optional Add-On): The AI Voice Receptionist is a separate specialized add-on product and is not included in the base ₹999/month plan. Pricing and billing terms for the AI Receptionist will be announced separately (Waitlist registration is available).
- No Hidden Cancellation Fees: Subscriptions can be canceled at any point directly from the clinic billing portal without lock-in periods.
3. Doctor & Healthcare Professional Responsibilities
By using The CliniQ AI, doctors and clinics agree and warrant that:
- Prescribing practitioners possess valid medical registrations recognized by the National Medical Commission (NMC) or respective State Medical Councils.
- All clinical details, dosages, and drug interactions on electronic prescriptions are independently reviewed and validated by the doctor prior to issuing them to patients.
- Clinic staff comply with applicable patient confidentiality guidelines and the Digital Personal Data Protection (DPDP) Act, 2023.
4. WhatsApp Business Platform & Patient Communications
The CliniQ AI provides communication automation powered by the Meta WhatsApp Business API. Clinics utilizing this feature agree that:
- Messages sent to patients must strictly relate to clinic appointments, queue tokens, e-prescriptions, lab requests, or direct clinic updates.
- Clinics must honor patient opt-out requests immediately. Any patient who replies "STOP" or "UNSUBSCRIBE" must not receive non-essential automated communications.
- Clinics must not use The CliniQ AI messaging infrastructure for unsolicited spam or non-clinical marketing campaigns.
5. Clinic Data Ownership & Medical Records Retention
You retain 100% ownership of your clinic records, doctor profiles, patient encounter histories, and generated prescription PDFs. We do not sell or monetize clinic or patient records.
In accordance with statutory Indian medical ethics (NMC guidelines), medical practitioners bear statutory responsibility for retaining patient clinical charts for the mandated retention period (minimum 3 years). Clinics may export their data at any time in standard formats.
6. Intellectual Property
The CliniQ AI software, design system, proprietary algorithms, brand assets, logos, and documentation remain the exclusive intellectual property of The CliniQ AI Technologies. You are granted a limited, non-exclusive, non-transferable license to utilize the service during your active subscription.
7. Limitation of Liability
To the maximum extent permitted by applicable Indian law, The CliniQ AI shall not be liable for any direct, indirect, incidental, or consequential damages resulting from medical malpractice, clinical misdiagnosis, clinical outcomes, telecommunication network downtime, or third-party WhatsApp service disruptions outside our direct control.
8. Governing Law & Exclusive Jurisdiction
These Terms shall be governed by, construed, and interpreted in accordance with the laws of the Republic of India. Any legal dispute, proceeding, or arbitration arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India.
